Broad Terms and Conditions in respect of Government Servants / Public Sector Undertaking Employees taken on Deputation in the service of NFL
  • Period of deputation
    • It will be specified in each individual case.

  • Pay
    • The deputationist would be entitled either to his own pay and grade of pay in his own parent department plus usual deputation allowance as per the Government of India instructions laid down and amplified from time to time or to our own scales of pay of the post against which he has been taken on deputation, subject to the condition that when the deputationist elects our pay, scale, his pay on our scale would be fixed as per Government rules on the subject as amended from time to time. In case minimum of the scale of post against which an individual is being taken on deputation is substantially higher than the pay drawn by him in his parent department, provisions of F.R. 35 would be invoked.

    • In case of Officers deputed to posts on the scale of Rs. 2250- 2750 (pre-revised) and above their pay would be fixed as per the provisions contained in the Ministry of Finance (Department of Expenditure) O.M. No.F- I(14)/E.III(B)/73 dated 09.10.73, which inter-alia provide that no deputation allowance will be granted in such cases and their pay will be fixed at the next appropriate stage of the deputation post.

  • Allowance
    • If the deputationist elects to retain his pay and scale of pay and draws deputation allowance, he should be entitled to draw the allowances (DA/ VDA) on his own pay and scale of pay in his own parent department plus the deputation pay as per his parent department rules. However, where the deputationist elects to come to our scale of pay, the allowances ( DA/ VDA) paid to him should be as per National Fertilizers Limited Rules.

  • Traveling allowance, Daily Allowance & Transfer T.A.
    • The deputationist, in the matter of the payment of Traveling allowance, Daily allowance, will be governed by NFL rules. However, on joining time granted to the deputationist for joining the post in NFL and on reversion from NFL on the expiry of the deputation period, traveling allowance and transfer T.A. will be regulated in terms of the rules of NFL to the deputationist. Joining time pay will be paid by NFL on appointment or reversion.

  • Leave
    • The deputationist will be governed by the leave rules as may be applicable to him in his parent deptt., for the period of this foreign service and the leave salary contributions would be paid to his parent deptt., by NFL every month as per normal rules. Leave salary will be payable by the parent department as leave salary contribution is paid by NFL.

  • Leave Travel Concession
    • During the period of his foreign service, the deputationist would be entitled to leave travel concession as per the rules of his parent department as amended from time to time and the cost thereof, would, would be borne by NFL.

  • Medical Facilities
    • The deputationist would be entitled to medical facilities not inferior to those admissible of his rank under his parent department rules. The expenditure on this account would be borne by NFL.

  • Pension, compulsory Provident Fund & Gratuity
    • During the period of foreign service, deputationist would continue to be governed by the pension or compulsory Provident Fund and Gratuity rules of his parent department and he would not be allowed to join any pension and gratuity scheme in NFL. The pensionary and gratuity contributions in respect of the deputationist would, however, be reimbursed by NFL to his parent department every month as per the normal rules.

    • The NFL would be responsible for the payment of any liability for leave salary charges for disability leave that may be granted on account of disability, if any, occurred in and through foreign service even though such disability manifests itself after termination of foreign service.

  • Compensatory / City Allowance
    • NFL will pay compensatory and other allowances for period of leave taken in / or at the end of the foreign service.

  • Commencement and termination from foreign service
    • The foreign service will commence from the date of the deputationist takes over chare of the post in NFL and would terminate on the date he is released from NFL.

  • Residential Accommodation
    • In respect of the deputationist who are posted in the Units / Divisions of the Company, the Management would, if possible, provide residential accommodation to the deputationist and charge House Rent from them as per NFL rules. Where accommodation is not provided HRA as permissible for place of posting will be allowed. In the case of the deputationist posted at Delhi, Bombay, Calcutta and Madras, house rent would be paid at the rate of 40% of the basic pay plus deputation pay after deducting 10% (basic pay + deputation pay ) from the deputationist. In other words, Management will not pay more then 30% of his basic pay plus deputation pay towards the residential accommodation hired by the deputationist.

  • Payment of any special allowance / charge allowance to the deputationist or any promotion while on deputation in our organization
    • The payment of any extra remuneration to the deputationist either in the form of the charge allowance, officiating allowance, officiating pay, special allowance, conveyance allowance, etc., would only be paid to him after obtaining the concurrence of the parent department.

  • Fixation of Pay on Permanent Absorption
    • The pay of deputationist on their permanent absorption in public interest should be fixed on the deputation post by protecting the deputation allowance and if pay plus deputation allowance do not fit in the scale of the deputation post, the difference should be treated as personal pay, to be absorbed in future increments on the prescribed grade of the deputation post.

  • Seniority
    • The seniority of officer opting for service in NFL would be fixed in a particular grade with effect from the date of their original deputation to that grade and not from the date of exercising their option, regardless of the terms offered to them.

  • Earned leave Transferred from parent Department of an Employee Permanently absorbed in NFL - How to Regulate
    • In the case of employees who get permanently absorbed in NFL on transfer from another public sector enterprise, the amount received from their parent Enterprises in respect of Earned Leave would be reimbursed to them.

    • The Earned leave ( i.e. , quantum of Earned leave, for which leave salary has been paid to the company by the concerned department of the employee on the date of his absorption earned by him till the date of his absorption) will be allowed to be kept as a separate reserve in the leave account in the company to be availed of by him as and when necessary, independent of the leave earned by him in the company after absorption. As regards availing of the leave and encashment thereof, the case of the concerned officer will be regulated by the rules of the company as may be applicable from time to time. In other words, in NFL, 50% of this separate reserve would also be available for encashment. Similarly at the time of superannuation / end of the contract period, the employee will be entitled to encash the leave available in the separate reserve independent of the encashment of leave earned by him during the service in the company, without applying the maximum limit of six months.

  • Procedure to be followed in case of Nfl Personnel on Assignment within the Country and outside the Country.

      NFL Corporate Plan has identified marketing of our specialized services within the country and abroad as one of the thrust areas. To implement the same, following guidelines would be followed

    • Identification of Assignment
      • All requests for such assignment would be handled by Corporate Planning Group. In the event requests are received directly by the units / office, the same are to be forwarded to Corporate Planning Group of Corporate Office, who will coordinate with the borrowing organization on the basis of approved rates of deputation revised from time to time.

    • Identification of Personnel
      1. Corporate Planning Group will identify the persons required by the borrowing organization either by contacting the units and division or from the data bank being maintained by the Corporate Planning Group. The names of these short listed personnel will be sent to the concerned units / office for getting their consent for availability and willingness of the concerned officer / employee for the assignment after showing them the detailed terms and conditions of their deputation including the net benefits and the monetary remunerations they would be getting while on deputations. A copy of the employee's willingness will be sent to the Corporate Personnel Department by the concerned unit / office

      2. The final selection will be made by Corporate Planning Department in consultation with the borrowing organization. However, if final selection is insisted by the borrowing organization through interview, the same will be organized through interview, the same will be organized by Corporate Personnel Deptt., at one of the unit where all the short listed officers / employees will be called.

      3. Personnel Departments at various units / office will be signing an agreement with the identified deputationists giving detailed terms and conditions of deputation under intimation to the Corporate Planning Department. A copy of the agreement will be sent to Corporate Personnel Department.

      4. Corporate Planning Group will coordinate with units as well as borrowing organization till such time a contract is entered into. After the contract is finalized the same will be passed on to Corporate Personnel Deptt., who will arrange to get the persons released from concerned units and further depute them to the borrowing organization.

      5. Out of the Personnel deputed Corporate Planning Dept.. will identify a team leader who will be responsible for looking after the welfare of his team and Coordinate / Liaise all the activities among the borrowing organization, his team and NFL. He will also be responsible for sending monthly attendance sheet duly countersigned by the nominated representative of the borrowing organization including hours of OT statement and Progress Report to Corporate Personnel as well as Corporate Planning with a copy to the respective units / office finance & accounts department for release of salary, etc., Corporate Personnel will coordinate with Corporate Finance regarding raising of the bills before any team is deputed to the borrowing organization.

      6. Corporate Personnel will also coordinate with the borrowing organization and the deputed staff during currency of the contract with respect to release payment, attendance and welfare of their families, etc.

      7. Based on the travel plans finalized by the Corporate Planning Department and the borrowing organization, Corporate Personnel will organize for the travel arrangements of the deputationist from Delhi onwards, if required. Where direct link to the place of deputation is available, the units / office employee will directly take care of his travel plans.

      8. For deputation abroad, corporate personnel department will assist in all the formalities connected with issuance of Visas, etc., for deputationist and organization / finalization of their travel plans.

      9. The terms and condition for such assignments will be as finalized by the Corporate Planning Department at Corporate Office from time to time. Normally, the terms and condition once finalized would remain in vogue during the process of assignment a clause wil be incorporated in the agreement that terms of assignment can be changed at any time without notice.

      10. In the event of any dispute, Corporate Planning will be responsible for sorting out the issue with the borrowing organization.

  • Board terms and conditions for deputation of NFL personnel to other Organization
    • The rates of deputation charges and over time charges chargeable from other Organization in respect of NFL personnel deputed to to other organization within India have been revised as under

      In case an employee, while on deputation, is detained beyond normal working hours of 48 hours a week with 8 hours a day or is required to work on holidays / off days, the borrowing organization will pay over time to NFL at the following rates :-

        Category O.T. Rates per hour
      i) Group -I Rs. 580/-
      ii) Group -II Rs.990/-
      iii) Group -III Rs.1250/-

      The above rates will come into force w.e.f. 1.12.2000 and will remain in force till further orders.

    • In addition to above following facilities will be provided by the borrowing organization to the deputed personnel
      1. Free fully furnished accommodation as per site conditions.

      2. Free transport for the team for performing official duties i.e. place of stay to work place and back and for other official duties.

      3. Canteen facilities at the rates as applicable to the employees of borrowing organization.

      4. Free medical treatment as applicable to the employees of the equivalent grade of borrowing organization / NFL rules.

      5. Deputationist will be entitled to visit their home on their leave at the traveling cost of borrowing organization by Air / their entitled class in NFL once in four months.

      6. They will be entitled for TA/ DA by entitled class for joining duty from place of posting to site and back on completion of the assignment.

      7. NFL employees will be entitled to avail casual leave @ one day per month during their deputation from their allowed 12 leaves.

      8. National / Gazetted Holidays will be as per borrowing organization list of holidays on joining back, he would be allowed flexible holidays after deducting Holidays availed from the allowed 12 flexible Holidays.

      9. Special Safety equipment aids / items will be provided as per requirement by the borrowing organization on returnable basis.

    • Rates of out of pocket expenses / subsistence allowance and other facilities payable to deputationist by NFL within India
      1. The deputationist will be entitled to the payment of out of pocket / subsistence allowance as under :-

      2. In addition to above the deputationist will be entitled for the facilities provided by the borrowing organization as per the agreement with them on the above mentioned lines.

      3. the deputationist will not be entitled to the payment of perks towards (i) local transport (ii) canteen facilities (iii) professional journal / periodicals during the period of deputation.
